Terms of Service

These Terms of Service ("Terms") govern your use of https://portfolio.aivcj.com and every page, demo, download and service on it (together, the "Site"). The Site is operated by Pulse (by AIVCJ) ("Pulse", "we", "us", "our"). By browsing the Site, verifying for a demo, or buying a theme you agree to these Terms, our Privacy Policy, our Refund Policy and the License Agreement. If you do not agree, please do not use the Site.

1. Who we are

Pulse designs and sells premium website themes and templates ("Themes") — for example Next.js applications, static HTML/CSS/JS versions and Shopify themes — together with their live demos and design files. You can reach us at hello@aivcj.com.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, and able to enter into a binding contract. If you use the Site on behalf of a company or client, you confirm you are authorised to accept these Terms for them, and "you" includes that organisation.

3. Verification and your account

  • To open live demos or to buy, we verify you with a one-time code sent to your WhatsApp number or email address. You agree to give accurate details and to verify only numbers and addresses you control.
  • A successful verification creates a session on your device so you are not asked again for every demo. Sessions expire automatically; you can sign out at any time from your account page.
  • You are responsible for activity under your session and for keeping your device secure. Tell us immediately at hello@aivcj.com if you believe your account has been misused.
  • We may refuse, suspend or end verification or access where we reasonably suspect fraud, abuse, automated access or a breach of these Terms.

4. Live demos and previews

Demos, screenshots, videos and Figma prototypes are provided for evaluation only. They may be watermarked, use placeholder content and differ slightly from the files you download. You must not copy, scrape, mirror, frame, record for redistribution, reverse engineer or otherwise extract demo code or assets, or attempt to bypass the verification gate. Demo access does not grant any licence to use a Theme.

5. Buying a Theme

5.1 Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle's Buyer Terms.

5.2 Prices and taxes. Prices are shown on each Theme page. Applicable taxes (such as VAT, GST or sales tax) are calculated and collected by Paddle at checkout based on your location and may be added to the displayed price. We may change prices at any time; changes never affect orders already paid.

5.3 Order acceptance. Your order is accepted when Paddle confirms payment. We may cancel and fully refund an order in case of an obvious pricing error, suspected fraud, or if we cannot deliver the product.

5.4 Delivery. Digital delivery is made immediately after payment through a secure download link and/or your account. Download links may expire for security; you can request a fresh link at any time by writing to hello@aivcj.com. Please keep your own backup copy of your files.

5.5 Licence, not sale. Buying a Theme gives you a licence to use it as described in the License Agreement. It does not transfer ownership of the Theme or its intellectual property.

6. Refunds

Because Themes are digital goods delivered instantly, all sales are final once the files have been delivered, except in the specific situations described in our Refund Policy (for example duplicate charges or a defect we cannot fix). Nothing in these Terms removes rights you have under mandatory consumer law.

7. Updates and support

We may release updates and fixes to Themes. Where we offer updates, they are provided to existing buyers at no extra cost through the same delivery channel. We provide reasonable support by email for bugs in the Theme as delivered; support does not cover custom development, third-party services, hosting, or modifications you make. We aim to respond within 2 business days.

8. Intellectual property

The Site, its design, text, graphics, code, demos and all Themes are owned by Pulse/AIVCJ or our licensors and are protected by copyright, trademark and other laws. Except for the licence you receive when you buy a Theme, no rights are granted to you. "Pulse", our logo and product names are our marks; you may not use them without our written permission.

9. Acceptable use

You agree not to:

  • use the Site or any Theme for unlawful, deceptive, defamatory, hateful or harmful purposes;
  • resell, sublicense, share or redistribute Themes or demo files except as the License Agreement allows;
  • interfere with the Site's security, availability or human-verification checks, or use bots, scrapers or automated means to access it;
  • impersonate any person, or verify with a phone number or email that is not yours;
  • upload or transmit malware, or attempt unauthorised access to our systems or other users' data.

10. AI concierge

The Site offers an AI-powered chat assistant to help you choose a Theme. Its answers are generated automatically, may be incomplete or inaccurate, and are not professional advice. The Theme page, these Terms and the License Agreement prevail over anything the assistant says. Do not share sensitive personal information in the chat.

The Site relies on and links to third-party services (for example Paddle for payments, messaging providers for verification codes, Figma for design prototypes and Shopify for Shopify previews). Their own terms and privacy policies apply to your use of them, and we are not responsible for their content or availability.

12. Disclaimer of warranties

Except as expressly stated in these Terms and to the maximum extent permitted by law, the Site, demos and Themes are provided "as is" and "as available". We do not warrant that they will be error-free, uninterrupted, compatible with every browser, framework version, plugin or hosting setup, or that they will meet your specific requirements. You are responsible for testing a Theme in your own environment, for your content, and for your own website's legal compliance (including accessibility, privacy and consumer law).

13. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity; and (b) our total liability for any claim relating to the Site or a Theme is limited to the amount you paid for the Theme giving rise to the claim in the twelve (12) months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

14. Indemnity

You agree to indemnify and hold harmless Pulse/AIVCJ from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or the License Agreement, your end products, or your content.

15. Suspension and termination

We may suspend or end your access to the Site, demos or downloads if you materially breach these Terms or the License Agreement. Licences for Themes you have paid for continue unless they are terminated under the License Agreement. Sections that by their nature should survive (including 8, 12, 13, 14 and 17) survive termination.

16. Changes to the Site and these Terms

We may update the Site and these Terms from time to time. The "Last updated" date shows the current version; material changes will be highlighted on the Site. Changes apply from publication and do not affect orders already completed. Continuing to use the Site means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of India. Before starting any formal proceedings, please contact us at hello@aivcj.com so we can try to resolve the issue informally within 30 days. Subject to any mandatory rights you have as a consumer in your country of residence, the competent courts of India have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.

18. General

These Terms (with the documents they reference) are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor of our business.
